Trial
The U.S. District Court for the District of Minnesota said Sept. 24
that it erred in instructing a jury that merely "making available" content
in a publicly accessible file-sharing folder was the equivalent of a
"distribution" under the Copyright Act. Chief Judge Michael J. Davis
said that evidence of actual distribution was required for the jury to
find Jammie Thomas infringed on recording labels' music distribution
rights. The fact that she placed music files in a shared folder on a

INTERNET COMMERCE Kentucky Court Set to Consider
Forfeiture of 141 Web Gambling Domain Names Oct.

A Kentucky court is set to determine Oct. 7 whether domain names used
for illegal Internet gambling activities by Kentucky residents should be
forfeited to the commonwealth. Kentucky's anti-gambling law permits
the commonwealth to seize devices used for illegal gambling
activities. At the urging of Gov. Steve Beshear (D), the
commonwealth's Justice & Public Safety Cabinet filed a lawsuit in rem
against 141 Internet domain names, seeking transfer of the domains on the
ground that they were used within the state in violation of Kentucky

School Free to Discipline Student for
Lewd MySpace Page Discussed on Campus School officials did not
infringe on a student's First Amendment rights when they suspended her
after her lewd MySpace page created a buzz on campus, the U.S. District
Court for the Middle District of Pennsylvania held Sept. 11. Judge
James M. Munley rejected the student's reliance on Tinker v. Des
Moines Independent Community School District, 393 US 503 (1969), a
case in which the U.S. Supreme Court held that school officials violated
students' First Amendment rights by punishing them for wearing arm bands

TELECOMMUNICATIONS Broadband Data Bill Passes After House,
Senate Compromise The House Sept. 29 by unanimous consent
made some technical changes to a revised Senate bill (S. 1492) that would
improve the collection of broadband data in the United States, sending it
back to the Senate for final approval. The Senate took up and passed
the compromise broadband bill by voice vote late Sept. 26, squeezing it in
among the last-minute bills of the year. The technical changes made

PRIVACY & SECURITY ISPs Call on Internet Ad Industry to
Unite Behind 'Opt-In' Privacy Policy Three leading Internet service
providers Sept. 25 said that all online advertising firms should be
willing to seek consumers' "opt-in" consent prior to monitoring their web
activity for marketing purposes. In testimony before the Senate
Committee on Commerce, Science, and Transportation, Verizon, AT&T, and
Time Warner Cable said that privacy concerns made it necessary for
industry to unite behind an opt-in regime and other best practices.

TAXATION Missouri Issues Ruling on Out-of-State
Company Engaged in Sales of Software An out-of-state corporation that sells
proprietary networking software to businesses is not subject to use tax on
its sales of canned software delivered electronically from outside of
Missouri to customers in Missouri, the Missouri Department of Revenue
advised. Although Missouri Regulations Section 10-109.050 provides
that the sale of canned software programs delivered by a tangible medium
are taxable as the sale of tangible personal property because the
corporation electronically delivers the software from outside the state to
its customer's computer in Missouri, the software is not subject to tax,
the Aug. 21 letter said. Missouri Department of Revenue

CRIMINAL LIABILITY Bush Signs Bill to Raise Prosecution of
Cybercrimes
President Bush Sept. 26 signed a bill with provisions to
increase federal prosecution of cybercrimes, including those targeting
U.S. companies. Among other things, the legislation (H.R. 5938)
extends the jurisdiction of federal computer fraud statutes to cover small
businesses and corporations and makes it a felony to employ "spyware" or
"keyloggers" to damage 10 or more computers, regardless of the aggregate
