Enforce 'Open Source' License to Control Use The holder of a copyright
in a computer program for model trains made available for free public
download may enforce an "open source" copyright license to control future
use and distribution of that work by downstream users, the U.S. Court of
Appeals for the Federal Circuit ruled Aug. 13. Vacating a ruling
that denied the copyright owner a preliminary injunction, the appellate
court found that the terms of the "Artistic License" on the plaintiff's
website are enforceable as conditions that govern a downloader's right to
modify and distribute the copyrighted work, not merely covenants to be

INTERNET COMMERCE 'Adversely Affected' CAN-SPAM Standard
Satisfied Upon Showing of ISP-Specific Harms An Internet service
provider who alleged ISP-specific harms due to alleged spam transmissions,
including network problems and costs associated with spam filtering, was
"adversely affected" and had standing to bring an action under the
CAN-SPAM Act, the U.S. District Court for the Northern District of
California held July 30. Though some courts have required Internet
service providers to allege harms directly related to spam to obtain
standing under CAN-SPAM, Judge Thelton E. Henderson held those decisions
placed an unreasonable burden on ISPs. ASIS Internet

PRIVACY & SECURITY Facebook Cited as Study in Tailoring
Effective Site-User Privacy Standards Online social networking
service Facebook may provide a good model for implementing effective user
privacy standards, an attorney who advises the service on privacy issues
said Aug. 9 at the American Bar Association's Annual Meeting.
Although Facebook has gotten some complaints from consumer advocates about
its data-collection practices, it has in place privacy controls that a
large percentage of its users actually employ, said Mozelle Thompson,
former commissioner of the Federal Trade Commission and a privacy advisor

TAXATION Washington Agency Finds No Basis for Use
of Multiple Points of Use Sourcing Doctrine A retailer owed sales tax
on the full selling price of prewritten computer software acquired through
a multiple use licensing agreement, the Washington Department of Revenue
Appeals Division recently ruled. The division found that the state's
sales and use tax laws do not differentiate between software acquired
under a single use license arrangement and software acquired under a

JURISDICTION & PROCEDURE Knowingly Sending Hundreds of E-Mails
Into Forum Establishes Jurisdiction There Sending over 100 e-mails
to individuals known to be located in Idaho is enough to satisfy the due
process "purposeful availment" requirement for finding jurisdiction there,
the U.S. District Court for the District of Idaho held July 18. The
court said that Idaho jurisdiction was proper over an individual accused
of intentionally sending bulk e-mails to Idaho residents when the sender
knew of the recipients' location, and when the harm the recipients
